Gersaín Rodríguez witnessed his brother’s murder by Colombian paramilitaries in January. His son and his nephew have been forcibly disappeared within the last decade. On 30 October paramilitaries beat and tried to kidnap him. Amnesty International believes his life is in danger.

On 30 October Gersaín Rodríguez was driving his motorbike in ZarzalMunicipality, Valle del Cauca Department, Colombia, when a car containing three men blocked his path, forcing him to stop. One of the men beat him and apparently attempted to take him away, but Gersaín Rodríguez managed to keep hold of his motorbike and flee. The men followed him until he encountered the local police commander and asked him for help. The commander said that he could do nothing.

On 31 October a friend received a text message while she was with Gersaín Rodríguez. It said: “Very happy with the triumph? You will be more happy when you see what we can do to Gersaín” (Muy contenta con el triunfo? Más contenta se va a poner cuando vea lo que le vamos a hacer a Gersaín). Gersaín Rodríguez went to the police and the commander told him that he should not denounce the threat to the Attorney General’s office.

On 10 January Gersaín Rodríguez witnessed the killing of his brother, Libardo Rodríguez, by paramilitaries. His son and nephew were forcibly disappeared in 2003 and 2006.Gersaín Rodríguez is a member of the Nydia Erika Bautista Human Rights Foundation and one of the leaders of the families of forcibly disappeared people in ZarzalMunicipality campaigning for information on their relatives. Since witnessing his brother’s murder, Gersaín Rodríguez has repeatedly requested protection measures, which have not been granted.

n  Call on the authorities to launch a full and impartial investigation into the attack, threats and attempted kidnapping of Gersaín Rodríguez as well as the killing of Libardo Rodríguez, and to publish the results and bring those responsible to justice;

n  Urge the authorities to take immediate action to dismantle paramilitary groups and break any links to the security forces, in line with stated government commitments and recommendations made by the UN and other intergovernmental organizations.

Earlier this year, after the witnesses denounced the killing of Libardo Rodríguez to the Office of the Attorney General, one of the witnesses received a call on his mobile phone from the alleged killer asking if  “the death had hurt him much” (le había dolido mucho el muerto) and made a reference to the recent statements made to the Office of the Attorney General. In another call he was told “we are also going to kill you” (también lo matamos). It is not clear how the paramilitary who allegedly killed Libardo Rodríquez obtained the number of the mobile phone of the witness he called. This is especially concerning given that the calls happened shortly after the witness gave his testimony at the Office of the Attorney General.

Gersaín Rodriguez’s, son Gersaín Andrés Rodríguez, was forcibly disappeared from his grandmother’s house in Medellin and his body was found on 19 June 2003 in GuarneMunicipality, Antioquia Department. His brother’s son, Julián Alberto Rodríguez López, was forcibly disappeared in 2006

Human right defenders and those campaigning for justice have been particularly vulnerable to threats and killings in recent years. Most of these attacks are attributed to paramilitary groups often operating in collusion with the security forces. Guerrilla groups have also targeted human rights defenders and other social activists deemed to be a threat to their interests.

Colombia's paramilitary groups supposedly demobilized in a government-sponsored process that began in 2003, but it is clear from the threats against human rights organizations and trade unions, in Valle de Cauca and elsewhere, that they are still operating.

Gersaín Rodríguez presenció en enero el asesinato de su hermano a manos de paramilitares colombianos. Su hijo y su sobrino fueron víctimas de desaparición forzada en el último decenio. El 30 de octubre, unos paramilitares lo golpearon e intentaron secuestrarlo. Amnistía Internacional cree que su vida corre peligro.

El 30 de octubre, Gersaín Rodríguez conducía su motocicleta en el municipio de Zarzal, en el departamento colombiano del Valle del Cauca, cuando un automóvil con tres hombres le bloqueó el paso y le obligó a detenerse. Uno de los hombres lo golpeó y, al parecer, intentó llevárselo, pero Gersaín Rodríguez consiguió mantenerse en su motocicleta y escapar. Los hombres lo siguieron hasta que se encontró con el comisario de la policía local y le pidió ayuda. El comisario dijo que no podía hacer nada.

El 31 de octubre, una amiga de Gersaín Rodríguez recibió un mensaje de texto cuando estaba con él. El mensaje decía: “¿Muy contenta con el triunfo? Más contenta se va a poner cuando vea lo que le vamos a hacer a Gersaín?”. Gersaín Rodríguez acudió a la policía, pero el comisario le dijo que no debía denunciar la amenaza a la Fiscalía General.

El 10 de enero, Gersaín Rodríguez presenció la muerte de su hermano, Libardo Rodríguez, a manos de paramilitares. Además, su hijo y su sobrino fueron víctimas de desaparición forzada en 2003 y 2006.Gersaín Rodríguez es miembro de la Fundación Nydia Erika Bautista para los Derechos Humanos y uno de los líderes de las familias de personas desaparecidas en el municipio de Zarzal que hacen campaña para conseguir información sobre sus familiares. Desde que presenció el asesinato de su hermano, Gersaín Rodríguez ha solicitado reiteradamente medidas de protección, que no le han concedido.

Escriban inmediatamente, en español o en su propio idioma:

n  Expresando preocupación por la seguridad de Gersaín Rodríguez y pidiendo que se establezcan medidas de protección que la garanticen, conforme a sus deseos;

n  Pidiendo a las autoridades que lleven a cabo una investigación exhaustiva e imparcial sobre la agresión, las amenazas de muerte y el intento de secuestro sufridos por Gersaín Rodríguez y también sobre el homicidio de Libardo Rodríguez, que hagan públicos sus resultados y que procesen a los responsables;

n  Instando a las autoridades a tomen medidas inmediatas para desmantelar los grupos paramilitares y romper los vínculos que puedan tener con las fuerzas de seguridad, de acuerdo con los compromisos expresos del gobierno y con las recomendaciones formuladas por la ONU y otras organizaciones intergubernamentales.

Hace unos meses, tras la denuncia sobre el homicidio de Libardo Rodríguez presentada ante la Fiscalía General por testigos, uno de ellos recibió en su teléfono móvil una llamada del presunto homicida, que le preguntó si “le había dolido mucho el muerto” y aludió a las recientes declaraciones realizadas ante la Fiscalía General. En otra llamada le dijeron que “también lo matamos”. El paramilitar que presuntamente mató a Libardo Rodríguez tenía el número del teléfono móvil del testigo con el que habló; no está claro cómo lo consiguió, lo que resulta especialmente preocupante si tenemos en cuenta que el testigo recibió las llamadas poco después de declarar ante la Fiscalía General.

Gersaín Andrés Rodríguez, hijo de Gersaín Rodríguez, fue víctima de desaparición forzada cuando se lo llevaron de la casa de su abuela en Medellín; el 19 de junio de 2003 hallaron su cadáver en el municipio de Guarne, departamento de Antioquia. El hijo de su hermano, Julián Alberto Rodríguez López, fue víctima de desaparición forzada en 2006.

En los últimos años, los defensores y las defensoras de los derechos humanos y quienes hacen campaña en favor de la justicia han estado especialmente expuestos a amenazas y homicidios. La mayoría de estos ataques se atribuyen a grupos paramilitares que a menudo actúan en connivencia con las fuerzas de seguridad. Los grupos guerrilleros también atacan a los defensores y las defensoras de los derechos humanos y a otros activistas sociales a los que consideran una amenaza para sus intereses.

Los grupos paramilitares de Colombia supuestamente se desmovilizaron en un proceso promovido por el gobierno que comenzó en 2003 pero, por las amenazas realizadas contra organizaciones de derechos humanos y sindicatos, tanto en el Valle del Cauca como en otros lugares, está claro que siguen actuando.
